By booking a trip with Custom Cat Charters, located in Marathon, Florida, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

Booking and Reservations

1. Reservations: All bookings are subject to availability and confirmation. Reservations can be made online, over the phone, or in person.
2. Deposit: A deposit of 20% of the total charter fee is required at the time of booking to secure your reservation.
3. Balance Payment: The remaining balance is due prior to eparture.
4. Cancellation Policy:
   • Cancellations made more than 14 days before the charter date will receive a full refund of the deposit.
   • Cancellations made between 7-14 days before the charter date will receive a 50% refund of the deposit.
   • Cancellations made less than 7 days before the charter date will forfeit the deposit.
   • In the event of severe weather or unforeseen circumstances, Custom Cat Charters reserves the right to reschedule or cancel the trip with a full refund provided.

Charter Policies

1. Check-in: Guests are required to check in at least 30 minutes prior to the scheduled departure time.
2. Late Arrivals: If you arrive late, the duration of your charter may be reduced accordingly. No refunds will be provided for late arrivals.
3. No-shows: No refunds will be issued for no-shows on the day of the charter.
4. Weather Conditions: Custom Cat Charters operates at the discretion of the captain. Safety is our top priority. If the captain deems the weather conditions unsafe for the charter, we will reschedule the trip or offer a full refund.
5. Health and Safety: All participants must adhere to safety instructions provided by the crew. Custom Cat Charters reserves the right to terminate the charter if safety rules are not followed, without a refund.

Fishing and Snorkeling Policies

1. Fishing Licenses: Custom Cat Charters provides all necessary fishing licenses for guests.
2. Equipment: Fishing and snorkeling equipment is provided. Guests are responsible for the care of the equipment during the charter. Any damage or loss may incur additional charges.
3. Catch Policy: Guests may keep their catch within the limits of local regulations. Custom Cat Charters practices sustainable fishing and encourages catch and release.
4. Marine Life: Guests must respect the marine environment and wildlife. It is illegal to harm or harass marine life.

Liability and Indemnity

1. Assumption of Risk: By participating in a charter with Custom Cat Charters, guests acknowledge and accept the inherent risks associated with boating, fishing, and snorkeling activities.
2. Liability Waiver: Custom Cat Charters, its employees, and agents are not liable for any injury, loss, or damage to personal property arising from participation in our charters.
3. Indemnification: Guests agree to indemnify and hold harmless Custom Cat Charters, its employees, and agents from any claims, damages, or expenses arising from their participation in the charter.

Miscellaneous

1. Children: Children under 18 must be accompanied by an adult. Parents or guardians are responsible for the safety and behavior of their children during the charter.
2. Alcohol and Drugs: Alcoholic beverages are permitted in moderation. The use of illegal drugs is strictly prohibited and will result in the immediate termination of the charter without a refund.
3. Privacy Policy: Custom Cat Charters respects your privacy and will not share your personal information with third parties without your consent, except as required by law.
4. Governing Law: These terms and conditions are governed by the laws of the State of Florida. Any disputes arising from these terms shall be resolved in the courts of Monroe County, Florida.
